WHAT WE VERIFY

Title & Registry Status
  • Official Search: Verify proprietor(s), tenure (freehold/leasehold), acreage, and encumbrances (charges, cautions, restrictions). We obtain or validate an official search through the national land information system (Ardhisasa/NLIMS) and/or the relevant registry, consistent with the Land Registration Act, 2012.

  • Instrument trail (as available): Mutation history, mother title references, and any registered easements/wayleaves noted on the title. (Easements and restrictions are recorded under the Land Registration framework.)

  • Survey authenticity: Deed plan or FR/RIM references, beacon coordinates, and parcel geometry consistency against official maps/records.

  • Physical reconciliation (optional field check): Beacon presence/condition and visible encroachments; mapping of access roads and natural features to official records.

  • Development permission status: Confirm whether the parcel’s current use and any proposed development align with County development permission requirements under the Physical and Land Use Planning Act, 2019, and related regulations. Where Change-of-Use is needed, we flag process and prerequisites.

  • For agricultural land and other “controlled transactions,” we check whether LCB consent is required and, if already obtained, verify the documentation under the Land Control Act (Cap 302).

  • Determine whether the project falls within activities that require an Environmental Impact Assessment (EIA) and, if so, verify NEMA licensing status. Provide process guidance or status confirmation via NEMA’s licensing systems.

  • NCA Project Registration: For building works, verify that the project is registered with the National Construction Authority and that the engaged contractor/consultants are duly registered, per NCA guidance.

  • For apartments and townhouses, confirm if the project is aligned to the Sectional Properties Act, 2020 and Sectional Properties Regulations, 2021 (e.g., sectional plan preparation/registration, common property governance). This reduces title risks associated with legacy long-term sub-leases.

  • Land rent & County rates status (clearances/arrears) where records are accessible; flag implications for transfer.
